1. Acceptance of Terms

By downloading, installing, accessing, or using the Kerala Bus Mod Livery app ("App"), you ("User," "you," or "your") agree to be bound by these Terms & Conditions ("Terms") and our Privacy Policy. If you do not agree to all of these Terms, you must not download, install, or use the App. Continued use of the App after any update to these Terms constitutes your acceptance of such changes.

2. Description of Service

Kerala Bus Mod Livery is a content distribution platform that aggregates and delivers downloadable digital assets - including but not limited to bus livery designs, horn sound packs, vehicle mods, map mods, car mods, truck mods, upgrade packs, templates, and related game modification files - intended for use with third-party bus simulation games.

The App provides:

• Free Content: Accessible to all users at no cost, supported by advertisements.
• Premium Content: Requires watching a rewarded advertisement or redeeming Premium Passes (purchased via in-app purchase) to unlock.
• Early Access Content: Select new content may be made available early to users who redeem Premium Passes at a designated Early Access pass cost before the general release date. After the Early Access period expires, this content transitions to standard premium or free access.
• Upgrade Packs: Specialised modification packages (e.g., vehicle upgrades, graphics packs, interior mods) that may have their own access tier and Premium Pass cost.

2.1 Content Categories

The App organises content into multiple categories, which may include but are not limited to:

• Bus Mods & Liveries
• Horn Packs
• Map Mods
• Car Mods
• Truck Mods
• Upgrade Packs (vehicle upgrades, graphics packs, interior modifications, etc.)
• Templates

New content categories may be added at any time without requiring a separate update to these Terms.

3. Third-Party Content - Ownership, Licensing & Disclaimer

3.1 Role of Kerala App Creators

Kerala App Creators operates as a content aggregation and distribution platform. Our role includes:

• Creating original content and curating third-party Creator content for distribution through the App.
• Providing the technical infrastructure (servers, CDN, download management) for content delivery.
• Categorising and presenting content in a user-friendly interface.
• Managing access tiers and the Premium Pass system for content monetisation.

3.2 Moderation & No Warranty of Third-Party Content

While Kerala App Creators employs reasonable moderation measures and actively responds to user reports to maintain content quality, it is not possible to guarantee that every individual item has been independently reviewed or verified before publication. Kerala App Creators does not endorse, warrant, or guarantee the accuracy, quality, safety, compatibility, legality, or fitness for any particular purpose of any third-party Creator content distributed through the App. All third-party content is provided on an "as is" and "as available" basis.

3.3 User Assumption of Risk

By downloading and using any content from the App, you acknowledge and agree that:

• You download and use all content entirely at your own risk.
• Kerala App Creators shall not be liable for any damage, loss, corruption, incompatibility, or malfunction arising from your download or use of any content obtained through the App, including but not limited to damage to your device, game data, save files, or third-party game installations.
• Content compatibility with specific game versions, device models, or operating system versions is not guaranteed.
• You are solely responsible for ensuring that any content you download is compatible with your device and the intended third-party game.

3.4 Intellectual Property of Third-Party Content

All intellectual property rights in third-party Creator content - including but not limited to designs, artwork, audio files, and modifications - remain with the respective Creators. Kerala App Creators has obtained distribution rights or licenses from Creators to host and distribute their content through the App. This does not transfer ownership of such content to Kerala App Creators or to you.

3.5 Content Removal & DMCA/Takedown Requests

If you are a content creator or rights holder and believe that content hosted on the App infringes your intellectual property rights, please contact us at [email protected] with the following information:

• Your name and contact information.
• A description of the copyrighted work you claim has been infringed.
• The specific content within the App that you believe infringes your rights.
• A statement that you have a good-faith belief that the use is not authorised.
• A statement, under penalty of perjury, that the information you provide is accurate and that you are the rights holder or authorised to act on behalf of the rights holder.

We will review all valid takedown requests and remove infringing content within a reasonable timeframe.

4. Eligibility

The App is rated "Everyone" on Google Play and is suitable for all age groups. If you are under the age of legal majority in your jurisdiction, your parent or legal guardian must agree to these Terms on your behalf before you use the App. The App contains optional in-app purchases and advertisements - we recommend enabling parental controls on your device.

5. User Accounts

Premium features and certain functionality require signing in with Google Sign-In. You are responsible for maintaining the confidentiality and security of your account credentials and for all activity that occurs under your account.

Your account is bound to one active device at a time. Signing in on a new device automatically deauthorises the previous device.

You may permanently delete your account at any time from the App drawer → "Delete Account." This irrevocably removes all data including Premium Pass balance, transaction history, and associated records. Unused Premium Passes are non-refundable upon account deletion.

6. Premium Content, Access Tiers & Monetisation

6.1 Content Access Tiers

Content within the App is classified into the following access tiers:

• Free Tier: Content available to all users. Free downloads may be preceded by an interstitial advertisement.
• Premium Tier: Content that requires either watching a rewarded video advertisement or redeeming Premium Passes. The number of Premium Passes required varies by content item (the "Pass Cost") and is displayed on each content item before download.
• Early Access Tier: Newly released content that is available exclusively to Premium Pass holders for a limited period before general release. Early Access content requires a designated Early Access Pass Cost (which may differ from the standard Pass Cost) to download during the Early Access window. After the Early Access period expires, the content transitions to its standard access tier and pass cost.

6.2 Rewarded Ads (Free Method to Unlock Premium Content)

Users may unlock premium content by watching a short rewarded video advertisement. A daily limit (currently 10 rewarded ads per day) and a cooldown period (currently 5 minutes between ads) apply. The daily limit resets at midnight local time. These limits may be adjusted at any time at our discretion.

6.3 Premium Passes (Paid Method)

Premium Passes are available as consumable in-app purchases via Google Play Billing. Each purchase grants a specific number of Premium Passes (as displayed at the time of purchase) for instant content downloads.

• Each premium download consumes the number of Passes indicated by the content item's Pass Cost.
• Passes do not expire and remain available until used or until account deletion.
• Passes are non-transferable and bound to your Google account.
• Pricing is displayed in your local currency as determined by Google Play.
• Premium Passes grant access to download specific content items; they do not confer ownership of the underlying intellectual property in the content.

6.4 Advertisements

The App displays various advertisement formats including interstitial ads, app-open ads, rewarded video ads, and native ads to support the free availability of the App. Advertisement frequency is subject to caps and may be adjusted at any time. The App uses third-party ad networks (including AppLovin MAX, Meta Audience Network, and Unity Ads) to serve advertisements.

6.5 What You Receive

When you use a Premium Pass or watch a rewarded advertisement to access content, you receive a limited, personal, non-commercial, non-exclusive, non-transferable, revocable license to download and use that specific content item for personal entertainment purposes within compatible third-party games. You do not receive ownership of the content, the right to redistribute it, or any commercial use rights.

7. Purchases & Refunds

All purchases are processed through Google Play Billing. We do not collect or store payment card information, UPI details, or any other payment method data.

Refunds for in-app purchases are handled in accordance with Google Play's refund policy. For purchase disputes or billing-related issues, you may contact us at [email protected].

• Consumed Premium Passes (i.e., passes that have already been used to download content) are generally non-refundable.
• If a technical issue prevents a download from completing after a pass has been consumed, contact us for assistance and we will investigate on a case-by-case basis.

8. User Conduct

You agree not to:

• Reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
• Use bots, scripts, automated tools, or any artificial means to generate fraudulent ad impressions, manipulate download counts, or interact with the App in an unauthorised manner.
• Circumvent, disable, or interfere with the Premium Pass system, content access tiers, device verification, or any other security or monetisation features of the App.
• Create multiple accounts or use emulators to exploit free content limits or promotional offers.
• Redistribute, resell, sublicense, or commercially distribute any content downloaded from the App.
• Use any content from the App for commercial purposes including but not limited to selling liveries, mods, or templates to third parties.
• Upload, transmit, or share any malicious code, viruses, or harmful data through the App.
• Misrepresent your identity, impersonate another user, or provide false information.

Violations of these conduct rules may result in immediate account suspension or permanent termination without notice and without refund of unused Premium Passes.

9. Content Reporting & Moderation

If you encounter content within the App that you believe is objectionable, offensive, infringing, or otherwise inappropriate, please report it to us at [email protected]. We will review all reports and take appropriate action, which may include removing the reported content.

10. Intellectual Property - App Platform

The App itself - including its source code, user interface design, layout, graphics, icons, logos, and branding - is the intellectual property of Kerala App Creators and is protected by applicable copyright and trademark laws. You may not copy, modify, distribute, or create derivative works of the App platform without our prior written consent.

For clarity: the intellectual property of third-party Creator content distributed through the App is governed by Section 3 above and belongs to the respective Creators.

11. Third-Party Games & Services

The content distributed through the App is designed for use with third-party bus simulation and vehicle simulation games, including but not limited to Bus Simulator Indonesia (BUSSID) by Maleo and Bus Simulator India (BUSSIN) by Highbrow Interactive.

We do not guarantee that content obtained through the App will be compatible with any specific version of any third-party game. Updates to third-party games may render previously compatible content incompatible. Kerala App Creators is not responsible for any loss of game data, progress, or save files resulting from the use of content downloaded through the App.

12. Disclaimers & Limitation of Liability

12.1 General Disclaimer

The App and all content distributed through it are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

12.2 Content Disclaimer

Kerala App Creators makes no representations or warranties regarding:

• The quality, accuracy, reliability, or completeness of any content available through the App.
• The compatibility of any content with your device, operating system, or third-party games.
• The availability of any particular content item at any given time.
• The safety or security of downloaded files beyond our reasonable server-side security measures.
• Any claims, representations, or descriptions made by third-party content Creators.

12.3 Limitation of Liability

To the maximum extent permitted by applicable law:

• Kerala App Creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, damage to devices, loss of game progress, or interruption of service, arising out of or in connection with your use of the App or any content downloaded through the App.
• Kerala App Creators' total aggregate liability for all claims arising out of or related to these Terms or the App shall not exceed the amount you have actually paid to Kerala App Creators through in-app purchases in the twelve (12) months immediately preceding the event giving rise to the claim, or ₹500 (INR Five Hundred), whichever is greater.
• Kerala App Creators is not liable for any actions, claims, losses, or damages arising from content created by third-party Creators, including but not limited to intellectual property disputes between Creators and other third parties.

12.4 Indemnification

You agree to indemnify, defend, and hold harmless Kerala App Creators, its owners, employees, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use or misuse of the App or any content obtained through the App.
• Your violation of these Terms.
• Your violation of any applicable laws or third-party rights.
• Any claim by a third party related to content you downloaded from the App.

12.5 Consumer Protection Rights

Nothing in these Terms is intended to limit or exclude any rights you may have under applicable consumer protection laws in your jurisdiction. Where any provision of these Terms conflicts with mandatory consumer protection legislation, the applicable statutory rights shall prevail.

13. Service Availability & Modifications

Kerala App Creators reserves the right to, at any time and without prior notice:

• Modify, update, or discontinue any feature, content, or functionality of the App.
• Add, remove, or modify content categories and access tiers.
• Adjust Premium Pass costs, pricing, ad limits, cooldown periods, and other operational parameters.
• Temporarily or permanently discontinue the App or any part thereof.
• Perform maintenance that may temporarily restrict access to the App.

We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App or its features.

14. Termination

We may suspend, restrict, or terminate your access to the App and/or your account at any time, with or without cause, including but not limited to violations of these Terms, suspicious activity, fraud, or abuse. Upon termination:

• All licenses granted to you under these Terms immediately cease.
• Unused Premium Passes are forfeited and are non-refundable.
• You must cease all use of the App and delete any downloaded content.

You may terminate your use at any time by uninstalling the App and deleting your account through the in-app "Delete Account" option.

15. Changes to These Terms

We may update these Terms at any time to reflect changes in our services, features, legal requirements, or other factors. When we make changes:

• The "Last Updated" date at the top of this page will be revised.
• For material changes that significantly affect your rights, pricing, or refund policies, we will provide at least 7 days' notice through the App or via the email associated with your account before the changes take effect.
• Your continued use of the App after the notice period (or after the updated "Last Updated" date for non-material changes) constitutes your acceptance of the revised Terms.
• If you do not agree to the revised Terms, you must stop using the App and delete your account.

16. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Kerala, India.

Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at [email protected]. We will endeavour to resolve disputes within 30 days of receipt.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Kerala App Creators regarding the use of the App and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written, relating to the App.
